Zportify is a sports aggregator platform that facilitates discovery, booking, and marketing of turfs, sports venues, and events. We act only as an intermediary between users and merchant partners (venue owners, service providers, and event organizers).
By using Zportify, you acknowledge and agree that:
- Zportify does not own or operate any of the sports facilities listed on the platform.
- All services are provided by independent merchant partners.
- Any disputes, claims, or concerns related to the service quality, facility condition, or partner behavior must be addressed directly with the respective merchant partner.
2. Assumption of Risk
Participation in sports and physical activities involves inherent risks, including but not limited to:
- Physical injury, illness, accidents, or even death.
- Damage to personal property.
- Weather-related cancellations or disruptions.
By making a booking through Zportify, you acknowledge that you voluntarily assume all risks associated with participation in sports activities.
3. Waiver of Liability
To the maximum extent permitted by law, you agree that Seleqt AI Solutions Pvt Ltd, its directors, employees, and affiliates (collectively, “Zportify”) shall not be held liable for:
- Any injury, loss, accident, or damage arising from your participation in activities booked via Zportify.
- Any negligence, misconduct, or default on the part of merchant partners.
- Any delays, cancellations, or service disruptions caused by factors beyond our reasonable control.
4. Medical Responsibility
Users are responsible for ensuring they are medically fit to participate in sports activities.
- Zportify does not provide medical advice or health assessments.
- In case of an emergency during participation, the responsibility to seek immediate medical care rests with the user and/or the merchant partner.
5. Insurance
Zportify does not provide personal accident insurance or medical coverage. Users are encouraged to arrange their own insurance before engaging in sports activities booked via the platform.
6. Indemnity
You agree to indemnify and hold harmless Zportify from any claims, damages, liabilities, or expenses (including legal fees) arising from:
- Your use of the platform.
- Your participation in activities booked through Zportify.
- Any breach of these terms or violation of laws.
7. Jurisdiction
This Disclaimer & Liability Waiver shall be governed by and construed in accordance with the laws of India, with exclusive jurisdiction resting in the courts of Coimbatore, Tamil Nadu.
